2. Contracting party

2.1 All contracts are concluded with Gant Switzerland AG, Wright-Strasse 9, 8152 Glattpark (Opfikon), Switzerland. Managing Directors: Fredrik Malm and Alexander Müller, HRB No. 9160 – Hamm District Court.

2.2 Our offer is exclusively directed at consumers in Switzerland.

2.3 The offer of Gant Switzerland AG is not available to minors.

3. Conclusion of contract

3.1 The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You may select products from the assortment by clicking on them and initially add them to a shopping cart without obligation. You may correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the “Buy now” button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order is sent by automated e-mail immediately after submission of the order and does not yet constitute acceptance of the contract on our part. We may accept your order by sending a separate order confirmation by e-mail or by delivering the goods within two days.

A binding contract is also concluded upon receipt of the full payment of the purchase price as well as any applicable shipping costs.

3.2 The measurements, drawings, explanations, descriptions and illustrations contained in the product descriptions are standard industry approximate values and therefore do not constitute a guarantee of these characteristics.

3.3 We store the contract text and send you the order details and our GTC by e-mail. The GTC can be viewed and printed at any time on our website at /agb. You may create a customer account. You will then have password-protected direct access (“My account”). After logging in, you may view information on your completed, open and recently shipped orders, as well as manage and store your address details, any payment details and any newsletter subscription.

3.4 The languages available for concluding the contract are German, French, Italian, and English.

3.5 The company reserves the right to block a customer account following a review in which indications of fraudulent activities are identified.
The blocking is carried out in order to protect the security of the company and its customers.
During the account blocking period, all personal data will be processed in accordance with the applicable data protection regulations and used solely for the purpose of reviewing and clarifying a suspicion of fraud. The company reserves the right to take legal action and, if necessary, file a criminal complaint in the event of a substantiated suspicion of fraud.

4. Delivery

4.1 We deliver exclusively by shipment. Unfortunately, self-collection of the goods is not possible.

4.2 Delivery is carried out exclusively within Switzerland.

4.3 We do not deliver to parcel lockers.

4.4 The delivery time is 2–5 days.

5. Prices, shipping costs and cost-bearing agreement

5.1 All stated prices include the applicable statutory taxes as well as any applicable customs duties.

5.2 For deliveries within Switzerland, shipping costs of CHF 7.50 will be charged for orders with a value below CHF 149.

5.3 Gant Switzerland AG is entitled to make partial deliveries, provided that this does not result in any significant disadvantage for the contractual partner.

6. Payment methods

The following payment methods are available to you: Visa, Mastercard, American Express, Klarna and PayPal.

6.1 Klarna – Purchase on account

You pay the invoice amount via the online provider Klarna. The invoice will be sent to you by e-mail after completion of the order. Payment is made directly to Klarna.

Klarna – Instant bank transfer

You use Klarna’s secure encryption to make the payment directly via online bank transfer.

Credit card

Your credit card will be charged upon completion of the order.

6.2 PayPal

You pay the invoice amount via the online provider PayPal. As a rule, you must be registered with PayPal or register first, authenticate yourself using your login details and confirm the payment instruction to us (exception may apply for guest access). Further information will be provided during the ordering process.

7. Promotional vouchers

7.1 Promotional vouchers (vouchers that are generally issued for promotional purposes in the form of a code with a specific validity period) cannot be purchased.

7.2 The creation of a customer account is not required in order to redeem promotional vouchers.

7.3 Where the promotional voucher provides for a minimum purchase amount or minimum order value, the voucher value constitutes a discount on the actual, final purchase price. The minimum purchase amount or minimum order value must therefore be actually reached with the respective purchase in order for the discount to be granted.

7.4 Promotional vouchers are valid only for the period specified in each case. They may be redeemed only once per order process. The combination of promotional vouchers is not possible. This also applies if different promotional vouchers are involved.

7.5 Promotional vouchers may only be redeemed before the order process is completed. After this point in time, redemption or offsetting is no longer possible. The value represented by the voucher cannot be paid out in cash nor does it bear interest. Even if a remaining balance exists, no refund will be made.

7.6 In the event that the order amount exceeds the value of a promotional voucher, it is possible to pay the difference using the payment methods accepted by Gant Switzerland AG.

7.7 In the event of a return of the goods (in whole or in part), the value of the promotional voucher will not be refunded. This applies if the promotional voucher was issued as part of a promotional campaign and no consideration was provided in return.

7.8 The voucher cannot be used for discounted items.

8. Warranty

8.1 There are statutory warranty rights for all goods from our shop.

8.2 We usually do not give guarantees. A guarantee with regard to the goods delivered by us therefore only exists if this has been expressly given, e.g. in the purchase confirmation for the respective article.

8.3 Usual or unavoidable material-related deviations in the quality, color, size, design and design of the goods are generally insignificant. In this respect, warranty claims do not usually arise. However, you are free to prove that such deviations are significant.

9. Retention of title

Gant Switzerland AG retains ownership of the sold items until full payment of the purchase price has been received.

10. Limitations of liability

10.1 The following limitations of liability do not apply to personal injury, health damage, or death, to the extent that they are attributable to Gant DACH GmbH. They also do not affect your rights under mandatory statutory provisions, such as product liability.

10.2 In the case of minor negligent breaches of duty, Gant DACH GmbH’s liability is limited to foreseeable, immediate, contract-typical damages, unless greater damage can be proven. Gant DACH GmbH is liable for damages caused by simple negligence only if no essential contractual obligation (delivery of the purchased item and transfer of ownership by the seller, as well as payment of the purchase price and acceptance of the purchased item by the buyer) has been breached, limited to contract-typical, foreseeable damages unless substantial damage can be proven.

10.3 The limitations of liability also extend to attributable breaches of duty by vicarious agents employed by Gant DACH GmbH.

10. Return policy

10.1 Returns
You always have a 30-day free return period for your purchase. Our women’s swimwear is delivered with hygiene seals that allow you to try them on at home. These seals must remain in place when you return the items. All swimwear must be tried on over underwear.

For hygiene reasons, we do not accept returns of underwear.

Returns are accepted only for perfumes that are unopened, in their original condition, and with completely intact packaging.

10.2 Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period expires fourteen days after the day on which you or a third party designated by you, other than the carrier, have taken possession of the goods.

To exercise your right of withdrawal, you must inform us (ch.kundenservice@gant.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or e-mail). You may use the attached withdrawal form, but this is not obligatory.
To meet the withdrawal deadline, it is sufficient that you send your communication concerning the exercise of your right of withdrawal before the withdrawal period expires.

10.3 Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you in connection with this contract, including delivery costs (except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract.
We will use the same means of payment as you used for the initial payment, unless expressly agreed otherwise; in any case, no fees will be charged to you for this reimbursement.
We may withhold reimbursement until we have received the goods or you have provided proof of having sent back the goods, whichever occurs first.

You must return or send the goods without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal of this contract to the following address:

The deadline is met if you return the goods before the expiry of the fourteen days. The costs of returning the goods are borne by us.

You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.

End of the right of withdrawal

11. Rights and obligations towards the customer

Gant reserves the right to block a customer account in cases of unusual purchasing, return, or complaint behavior. The blocking is done to protect the security of the company and its customers. During the period in which the account is blocked, all personal data will be processed in accordance with data protection regulations. The company reserves the right to take legal action if there is reasonable suspicion of fraudulent activity and, if necessary, to press charges.

13. Our right to vary these terms and conditions

12.1 We have the right to revise and amend these terms and conditions from time to time and our revised terms will appear on our Site.

12.2 You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products, in which case we may cancel your order).
